Palveluehdot: Auton poisto katosta
Nämä ehdot määrittävät Kattoauto.fi:n asiakkaiden itse suorittaman auton poiston katosta. Osallistumalla poistoprosessiin asiakkaat tunnustavat ja hyväksyvät sitoutuvansa näihin ehtoihin, mikä vapauttaa Kattoauto.fi:n vastuusta asiakkaan toimista aiheutuvissa asioissa.
Asiakkaan vastuu:
Asiakkaat ovat yksin vastuussa auton turvallisesta ja asianmukaisesta poistamisesta katosta. Tähän sisältyy kaikkien kiinnikkeiden irrottaminen, jotka pitävät auton kiinni kattorakenteessa. Asiakkaiden on noudatettava äärimmäistä varovaisuutta ja harjoittaa huolellista turvallisuutta poistoprosessin aikana.
Vastuuvapauslauseke:
Osallistumalla Kattoauto.fi:n tapahtumaan asiakkaat luopuvat peruuttamattomasti kaikista vaatimuksista, vastuista tai toimenpiteistä Kattoauto.fi:ä vastaan ja sen liittyvät yhtiöt, virkamiehet, johtajat, työntekijät, edustajat, seuraajat ja luovutukset aiheutuneista vahingoista, vammoista, vahingoista tai tappioista poistoprosessin aikana tai seurauksena. Tämä luopuminen kattaa mutta ei rajoitu ruumiinvammaan, omaisuusvahinkoon tai muihin välillisiin tai välittömiin vahinkoihin.
Korvausvelvollisuus:
Asiakkaat sitoutuvat korvaamaan, puolustamaan ja vapauttamaan Kattoauto.fi:n kaikista ja kaikista vaatimuksista, vastuista, vahingoista, tappioista, kustannuksista, menoista tai maksuista (mukaan lukien oikeudenkäyntikulut), jotka johtuvat tai liittyvät asiakkaan osallistumiseen poistoprosessiin, mukaan lukien mutta ei rajoittuen kolmansien osapuolien tekemiin vaatimuksiin.
Ei takuuta:
Kattoauto.fi ei anna mitään takuuta, suoraa tai epäsuoraa, koskien poistoprosessin turvallisuutta, tehokkuutta tai soveltuvuutta. Asiakkaat osallistuvat poistoprosessiin omalla vastuullaan ja ottavat täyden vastuun siitä aiheutuvista seurauksista.
Vastuun rajoitus:
Missään tapauksessa Kattoauto.fi:n, sen virkamiesten, johtajien, työntekijöiden, edustajien, seuraajien tai luovutusten vastuu ei voi olla asiakkaalle tai kolmannelle osapuolelle mistään suorista, epäsuorista, satunnaisista, erityisistä tai välillisistä vahingoista, jotka aiheutuvat poistoprosessista, riippumatta syytteestä ja vaikka niistä olisi ilmoitettu mahdollisuudesta tällaisiin vahinkoihin.
Sovellettava laki:
Nämä ehdot ja edellytykset ovat sovellettavissa EU:n kattoautojen kiinnitysdirektiiviin (EUCAD/1993/420), ilman että otetaan huomioon sen lakien ristiriitaisuutta.
Erotettavuus:
Jos näiden ehtojen jokin kohta todetaan soveltumattomaksi tai pätemättömäksi, kyseinen kohta poistetaan, eikä se vaikuta muiden ehtojen voimassaoloon tai pätevyyteen.
Koko sopimus:
Nämä ehdot muodostavat kokonaisen sopimuksen asiakkaan ja Kattoauto.fi:n välillä kattoauton itsepoistosta ja ne korvaavat kaikki aiemmat tai samanaikaiset sopimukset, viestinnät ja ehdotukset, olivatpa ne suullisia tai kirjallisia, osapuolten välillä kyseisestä asiasta.
Osallistumalla poistoprosessiin asiakkaat vahvistavat, että he ovat lukeneet, ymmärtäneet ja hyväksyneet sitoutuvansa näihin ehtoihin ja edellytyksiin. Nämä ehtojen rikkomukset voivat johtaa Kattoauto.fi:n tarjoamien palveluiden lopettamiseen.
Terms of Service: Car Removal from Ceiling
These terms and conditions govern the self-removal of a car suspended from the ceiling by customers of Kattoauto.fi. By engaging in the removal process, customers acknowledge and agree to be bound by these terms, thereby absolving Kattoauto.fi of any liability arising from customer actions.
Customer Responsibility:
Customers are solely responsible for the safe and proper removal of the car suspended from the ceiling. This includes detaching any attachments securing the car to the ceiling structure. Customers must exercise extreme caution and adhere to all safety protocols during the removal process.
Waiver of Liability:
By engaging in the self-removal process facilitated by Kattoauto.fi, customers irrevocably waive any and all claims, demands, liabilities, or causes of action against Kattoauto.fi and its affiliates, officers, directors, employees, agents, successors, and assigns arising from or related to any harm, injury, damage, or loss incurred during or as a result of the removal process. This waiver encompasses, but is not limited to, bodily injury, property damage, or any other consequential or incidental damages.
Indemnification:
Customers agree to indemnify, defend, and hold harmless Kattoauto.fi from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including legal fees) arising out of or relating to the customer’s engagement in the removal process, including but not limited to any claims brought by third parties.
No Warranty:
Kattoauto.fi provides no warranty, express or implied, regarding the safety, efficacy, or suitability of the removal process. Customers engage in the removal process at their own risk and assume full responsibility for any consequences arising therefrom.
Limitation of Liability:
In no event shall Kattoauto.fi, its officers, directors, employees, agents, successors, or assigns be liable to the customer or any third party for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the self-removal of the car from the ceiling, irrespective of the cause of action and even if notified of the possibility of such damages.
Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of EU Ceiling Car Attaching Directive (EUCAD/1993/420), without regard to its conflict of law principles.
Severability:
If any provision of these terms is found to be unenforceable or invalid under any applicable law, such provision shall be deemed severed from these terms without affecting the validity or enforceability of the remaining provisions.
Entire Agreement:
These terms constitute the entire agreement between the customer and Kattoauto.fi regarding the self-removal of the car from the ceiling and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between the parties regarding such subject matter.
By proceeding with the self-removal process, customers affirm that they have carefully read, understood, and agreed to be bound by these terms and conditions. Failure to comply with these terms may result in the termination of services provided by Kattoauto.fi.
